These Terms and Conditions (“Terms”) govern your use of www.carolinasoccerfactory.com, the CarolinaSoccerFactory mobile application, and Carolina Soccer Factory’s related programs, registrations, content, and services (collectively, the “Services”).

By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1. Eligibility and Guardian Consent

If you register a minor participant, you represent that:

  • You are the participant’s parent or legal guardian or have authority to act for the participant
  • You have reviewed and accepted these Terms and the Privacy Policy
  • The information you provide is accurate and complete
  • You consent to the participant’s registration and participation
  • You accept responsibility for the participant’s conduct and obligations

2. Accounts

You agree to:

  • Provide accurate and current information
  • Keep your account credentials confidential
  • Notify us of unauthorized account access
  • Accept responsibility for activity under your account
  • Not share or misuse your account

We may suspend or terminate accounts containing inaccurate information or used in violation of these Terms.

3. Registration and Participation

Registration may be subject to additional program rules, schedules, waivers, eligibility requirements, medical forms, and consent forms.

Carolina Soccer Factory may:

  • Limit enrollment
  • Change coaches, schedules, locations, or program details
  • Cancel or postpone activities
  • Require completed waivers or medical information
  • Refuse or cancel registration when reasonably necessary
  • Remove a participant for safety, conduct, eligibility, or administrative reasons

Registration is not guaranteed until accepted by Carolina Soccer Factory and any required payment has been received.

4. Payments, Cancellations, and Refunds

Prices, deposits, registration fees, installment payments, and other charges will be displayed during registration or otherwise communicated to you.

Payments may be processed through Stripe. By submitting payment information, you authorize Carolina Soccer Factory or Stripe to process the applicable charges.

Unless a separate written program policy states otherwise:

  • Registration fees and deposits are nonrefundable
  • Refunds, credits, cancellations, and transfers are subject to the applicable program’s published policy
  • Applicable taxes and processing fees may be charged
  • Failed or reversed payments may result in cancellation or suspension of registration
  • You are responsible for maintaining accurate payment information

Refund, cancellation, credit, or transfer requests must be submitted in writing to info@carolinasoccerfactory.com. Approval is at Carolina Soccer Factory’s discretion unless a mandatory refund right applies under applicable law or a separate written program policy provides otherwise.

5. Assumption of Risk

Soccer, athletic training, and related activities involve inherent risks, including injury, illness, falls, collisions, weather conditions, equipment failure, and risks arising from the conduct of participants or third parties.

Participants and their parents or legal guardians voluntarily assume the risks associated with participation to the fullest extent permitted by law.

Participation may require a separate liability waiver, medical authorization, emergency treatment authorization, or parental photo and video waiver. If a separate signed waiver conflicts with these Terms, the signed waiver controls regarding the subject matter it addresses.

6. Medical and Emergency Information

Parents and legal guardians are responsible for providing accurate medical, allergy, medication, emergency contact, and accessibility information.

To the extent permitted by law, you authorize Carolina Soccer Factory and its personnel to seek or arrange emergency assistance for a participant when reasonably necessary. Emergency personnel, medical providers, and insurers may operate independently from Carolina Soccer Factory.

You retain ownership of content you submit. Information provided through the Services is not medical, legal, financial, or professional advice.

13. Limitation of Liability

To the fullest extent permitted by law, Carolina Soccer Factory LLC and its owners, officers, employees, coaches, contractors, volunteers, affiliates, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to the Services or participation in activities.

To the fullest extent permitted by law, our total liability for claims arising from the Services will not exceed the amount paid to Carolina Soccer Factory for the specific service giving rise to the claim during the 12 months before the event.

This limitation does not apply where prohibited by law or to liability that cannot legally be limited.

14. Indemnification

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Carolina Soccer Factory LLC and its owners, officers, employees, coaches, contractors, volunteers, affiliates, licensors, and service providers from claims, damages, liabilities, costs, and expenses arising from:

15. Suspension and Termination

We may suspend or terminate your account or access to the Services if we believe you have violated these Terms, created a safety risk, failed to pay applicable fees, or otherwise misused the Services.

You may stop using the Services at any time. Termination does not automatically entitle you to a refund.

Provisions concerning payment obligations, intellectual property, disclaimers, liability limitations, indemnification, privacy, and disputes survive termination.

16. Privacy

Our collection and use of personal information are described in our Privacy Policy:

www.carolinasoccerfactory.com/privacy-policy

17. Governing Law and Disputes

These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law principles.

Before filing a legal claim, the parties agree to attempt in good faith to resolve the dispute by contacting one another in writing.

Any permitted legal action must be brought in the state or federal courts located in Mecklenburg County, North Carolina, unless applicable law requires otherwise.

Nothing in this section limits rights that cannot legally be waived.

18. Changes to These Terms

We may update these Terms periodically. Updated Terms will be posted through the Services with a revised “Last Updated” date. Continued use of the Services after the effective date constitutes acceptance of the updated Terms.

19. Severability and Waiver

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver of our right to enforce it later.

20. Entire Agreement

These Terms, the Privacy Policy, applicable registration policies, parental waivers, medical authorizations, and other written policies referenced here constitute the agreement between you and Carolina Soccer Factory regarding the Services.
